New twist on a recurring problem

In this PE article on new presiding judge Thomas Cahraman there is a useful discussion on an issue which may be adding to the congestion of our civil courts.

There are 76 judges and commissioners. They "face 43 death penalty cases that are making their way to trial. San Diego County, with a 2.9 million population, has seven pending death penalty cases, Cahraman said."

"Each death penalty case occupies a judge for about 10 weeks ... many of our judges are assigned death penalty cases in addition to their regular workload. " There is no question that this many death penalty cases adds substantially to the backlog.

Local cities are incurring huge attorney's fees

The PE reports here that

The amount some Inland cities plan to spend on legal services this year:

Hemet: $1.3 million

Temecula: $721,300

Banning: Between $600,000 and $800,000

Highland: $172,500

Grand Terrace: $74,000

If you think that $1.3m is a lot for a small hamlet like Hemet, read the article. The prior year its legal fees were $2.1m.

Fireman pleads not guilty in dog death

Fireman Glynn Johnson plead not guilty to animal cruelty charges. See here for the PE's report. Interestingly, the dog's owners filed a lawsuit against the fireman. As a public service, the IELB is attaching a copy of pertinent pages of the lawsuit. (The actual copy can be accessed on the Riverside County Superior Court website). It paints a vivid portrait of a horrible act. Obviously, it is one sided, but....

Dog attack now going to trial

As readers know, the IELB covered the beating of a dog after said dog bit a local off duty fireman. Now, the dog beating is going to trial. See here for the update on the story.

"The story notes that A physician's assistant told police that a break to the bone in Johnson's thumb was unlikely to be caused by a small dog. Karley weighed 42 pounds."

So the dog bites the fireman's thumb so hard that it breaks it, the fireman beats the dog, and now the prosecutor files felony charges against the fireman.

Unfortunately, this case will be added to the thousands of other criminal cases pre-empting civil cases and further adding to the civil case back log.

Representative Calvert in the news

The PE reports that "A lawsuit alleging a Jurupa water agency committed fraud when it sold land to Rep. Ken Calvert and his partners will be allowed to proceed." The article says nothing about the nature of the hearing but it was probably a demurrer. A demurrer challenges the sufficiency of the facts which are assumed true. The question is whether the facts as alleged state a sufficient basis for a lawsuit.

Local attorney becomes Mayor of Moreno Valley

Local consumer attorney Richard Stewart became mayor of Moreno Valley on January 6, 2009. See here for the PE's report on the story. Congratulations are in order to an outstanding attorney and person.

Medical Marijuana Lawsuit filed

The PE reports that medical marijuana activist Scott Bledsoe, of Crestline filed a lawsuit Monday against San Bernardino County for refusing to issue him a medical marijuana card. Interestingly, Riverside and Orange counties issue cards, while San Bernardino and San Diego counties do not.
